Ubisoft is taking The Black Eyed Peas to court for $1m over a breach of contract dispute concerning the iOS port of The Black Eyed Peas Experience.
The hip hop group's eponymous dance-based game was launched on the Wii and Xbox 360 last year and the group has dragged its heels on granting approval for a version intended for the iPad and iPhone. To date, Ubisoft has spent $233,000 on the mobile port.
The Black Eyed Peas had agreed to license out their names and likenesses to Ubisoft to use as part of a video game on 'all existing and future handheld and home consoles and iOS platforms, including the iPhone and iPad' as reported by Courthouse News.
The contract also stated that BEP Music, representing the group, would respond to the submission of any games within 10 days to give the ok or request any changes. Ubisoft has heard nothing from BEP Music concerning the iOS version since March.
As a result of the lack of input from The Black Eyed Peas, Ubisoft claims that it has suffered losses of more than $1m, comprised of a combination of development costs and loss of profits.
The music game genre has spawned several lawsuits, although this could be the first time a developer has taken an artist to court. Earlier this month, No Doubt settled its dispute with Activision out of court over the band members' likenesses being usable with non-No Doubt tracks in Band Hero.
