3D Realms, creator of the massively-delayed
Duke Nukem Forever, is being sued for copyright infringement over new title
Earth No More by Cinemagraphix Entertainment.
Cinemagraphix, which is a word we hate having to spell, is claiming that in 2005 it first came up with the idea for
Earth No More - a squad-based shooter for PC, Xbox 360 and PlayStation 3 - and pitched the idea to numerous publishers and teams, including 3D Realms.
Apparently, 3D Realms elected to pass on the game and sent Cinemagraphix away.
Then, in June 2007, 3D Realms announced a very similar sci-fi shooter called, you guessed it,
Earth No More.
Cinemagraphix is now claiming that 3D Realms stole the idea, along with the title and a series of concept art pieces - an allegation which, if true, could prove damning for 3D Realms.
Cinemagraphix is seeking $150,000 in damages, plus legal expenses and a share of the game's profits.
